1. About us

These Terms and Conditions apply to purchases made from AeroDesign.uk through our website, by telephone, by email or by invoice.

In these terms, “we”, “us” and “our” mean AeroDesign.uk. “You” and “your” mean the person or organisation purchasing from us.

2. These terms

Please read these terms before placing an order. By submitting an order, you agree to be bound by these terms.

Nothing in these terms limits or excludes any rights available to consumers under applicable UK law.

Where you are purchasing wholly or mainly for business purposes, the additional business-customer provisions in these terms will apply.

3. Products and product information

We take reasonable care to ensure that product descriptions, specifications, photographs and prices are accurate. However, images are for general illustration only, and colours, dimensions or minor product details may vary.

Manufacturers may alter product specifications, packaging, accessories or software without notice. Where a material change affects your order, we will contact you before dispatch, where reasonably possible.

You are responsible for checking that a product is suitable for your aircraft, installation, and intended use, and for any applicable regulatory or approval requirements, before ordering or installing it.

Product information provided on our website or in correspondence is general information only and does not replace the manufacturer’s manuals, approved installation data, professional engineering advice or applicable aviation regulations.

4. Orders

An order submitted through our website, by email or by telephone is an offer to purchase the products listed in the order.

Receipt of an order confirmation or automatic email does not necessarily mean that we have accepted the order. A contract is formed when we confirm acceptance, issue an invoice for an agreed order, or dispatch the products, whichever occurs first.

We may decline or cancel an order where:

  • the product is unavailable;
  • the price or description contains an obvious error;
  • payment cannot be authorised;
  • delivery restrictions apply;
  • we suspect fraud or unlawful activity; or
  • we cannot reasonably fulfil the order.

If we cancel an order after payment has been received, we will refund the amount paid for the cancelled products.

5. Prices

Prices are shown in pounds sterling unless stated otherwise.

Prices will be displayed as inclusive or exclusive of VAT as indicated on the website or quotation. Delivery charges, customs charges and other applicable costs will be shown separately where possible.

We may change prices at any time, but changes will not normally affect an order that we have already accepted.

If an obvious pricing error occurs, we may cancel the order and issue a refund or give you the option to purchase at the correct price.

6. Payment

We normally accept debit and credit card payments through Stripe. Card details are processed securely by Stripe and are not normally stored directly by AeroDesign.uk.

Payment is generally required in full before products are dispatched.

For certain high-value or specially arranged orders, we may accept payment by bank transfer after issuing an invoice. Bank transfer payment must be agreed with us in advance. Orders will not normally be processed or dispatched until cleared funds have been received.

You must use the invoice or order number as the bank transfer payment reference.

You confirm that you are authorised to use the payment method provided.

7. Product availability and lead times

Products shown on our website may be held in stock, supplied to order or ordered from the manufacturer or distributor.

Any stock indication, lead time or delivery date is an estimate unless we expressly confirm otherwise in writing.

Lead times may be affected by manufacturer availability, production delays, international transport, customs clearance or events outside our reasonable control.

Where an item becomes unavailable or is significantly delayed, we will contact you and may offer an alternative product, a revised delivery estimate or a refund.

8. Delivery

We normally use DHL for shipping, although another suitable carrier may be used where necessary.

Delivery charges are based on the destination, parcel size, weight, value and service selected. The applicable delivery cost will be shown at checkout or included in your quotation or invoice.

You are responsible for providing a complete and accurate delivery address. We are not responsible for delays or additional charges caused by incorrect or incomplete information supplied by you.

Delivery dates are estimates unless we have expressly agreed on a guaranteed delivery service in writing.

Once dispatched, tracking information will normally be provided where available.

9. Delivery inspection and damaged parcels

You should inspect the parcel and products as soon as reasonably possible after delivery.

Please notify us promptly if:

  • the parcel is visibly damaged;
  • an item is missing;
  • the wrong product has been supplied; or
  • a product appears to have been damaged in transit.

Please retain the product, shipping carton and all internal packaging while the matter is investigated. We may ask for photographs of the parcel, packaging, shipping label and product.

Signing for a delivery does not remove your legal rights where damage was not reasonably visible at the time of delivery.

10. International orders

International orders may be subject to import VAT, customs duty, clearance charges, brokerage fees or local taxes.

Unless we have expressly agreed otherwise in writing, these charges are the responsibility of the recipient and are not included in our product or delivery prices.

You are responsible for confirming that the products may legally be imported, installed and used in the destination country.

Customs clearance may delay delivery. We are not responsible for delays caused by customs authorities or for products detained because of local import restrictions.

11. Consumer cancellation rights

If you are a consumer purchasing online, by telephone or by email, you will normally have the right to cancel your order within 14 days after the day on which you receive the products.

To cancel, you must clearly tell us that you wish to cancel by email or in writing.

After notifying us, you must normally return the products within 14 days.

Cancellation rights may not apply to certain products, including:

  • products made or modified to your specification;
  • specially ordered personalised products;
  • sealed products that are not suitable for return for health or hygiene reasons once unsealed; or
  • other products excluded from cancellation rights by law.

Your statutory rights relating to faulty or misdescribed products are not affected.

12. Returns

Please contact us before returning any product so that we can provide return instructions and, where appropriate, a return reference.

Unless the product is faulty, damaged on delivery or incorrectly supplied, you are responsible for the cost and safe return of the product.

Returned products should be:

  • securely packaged;
  • complete with accessories, manuals and supplied parts;
  • in their original condition; and
  • accompanied by the order or invoice number.

You may inspect a product in the same way you reasonably could in a shop. We may reduce a refund where handling has gone beyond what is reasonably necessary and has reduced the product’s value.

You are responsible for returned products until they are received by us. We recommend using an insured and trackable delivery service.

13. Refunds

If you validly cancel a consumer order, we will issue the refund required by law.

We may wait until the returned products have been received, or until you provide evidence that they have been sent back, before issuing the refund.

Refunds will normally be made using the original payment method.

For a standard consumer cancellation, we will normally refund the basic outbound delivery charge. Additional costs for an upgraded or express delivery service may not be refundable.

Bank-transfer refunds will be returned to a verified account in the name of the original payer unless otherwise agreed.

14. Faulty products and statutory rights

Products supplied to consumers must be as described, of satisfactory quality and fit for any purpose made known to us and accepted by us.

Please contact us promptly if you believe a product is faulty, damaged or incorrectly described.

Depending on the circumstances and applicable law, you may be entitled to a repair, replacement, price reduction or refund.

We may inspect or test a returned product before confirming the appropriate remedy. Where no fault is found, or the problem results from incorrect installation, misuse, accidental damage or an external cause, the product may not qualify for a free repair or replacement.

Nothing in these terms affects your statutory rights.

15. Manufacturer’s warranty

New products are supplied with the applicable manufacturer’s warranty, where one is provided.

Warranty periods and conditions vary by manufacturer and product. The warranty may require proof of purchase and the product’s serial number.

Warranty cover will not normally apply to faults caused by:

  • incorrect wiring or installation;
  • failure to follow the manufacturer’s instructions;
  • unsuitable power supply or electrical faults;
  • unauthorised repair or modification;
  • misuse, neglect or accidental damage;
  • water, fire, impact, corrosion or contamination;
  • normal wear and tear; or
  • use outside the product’s stated specification.

Please contact AeroDesign.uk before returning any product for warranty assessment. Do not send equipment to the manufacturer or us without prior authorisation.

We may initially ask you to carry out troubleshooting, provide photographs, software versions, log files, wiring information or other diagnostic details.

Where necessary, we may coordinate the matter with MGL Avionics, a distributor, authorised repair centre or another relevant manufacturer.

16. Installation and aviation use

Avionics and aircraft equipment must be installed, configured, tested and operated correctly.

Unless we expressly agree to provide installation services under a separate written agreement, we supply products only and do not carry out or supervise installation.

You are responsible for ensuring that:

  • installation is carried out by a suitably competent person;
  • the manufacturer’s instructions are followed;
  • the aircraft’s electrical and mechanical systems are suitable;
  • all required inspections, approvals and paperwork are completed;
  • the installation complies with applicable aviation rules and airworthiness requirements; and
  • the equipment is tested before operational use.

No product should be relied upon as the sole source of safety-critical information unless it is designed, approved, installed and operated for that purpose.

Our product recommendations do not constitute approval of an aircraft modification or confirmation of regulatory compliance.

17. Software and firmware

Some products may contain software or firmware supplied by the manufacturer.

Your use of that software may be subject to separate manufacturer licence terms. You are responsible for following the update instructions and checking compatibility before installing an update.

Settings, configuration files and stored data should be backed up where possible before servicing, repairing, or updating. We are not responsible for data or settings lost during a repair or update unless the loss results from our failure to use reasonable care and skill.

18. Limitation of liability

Nothing in these terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation or breach of your statutory rights.

We are not responsible for losses caused by:

  • incorrect installation, configuration or operation;
  • failure to follow manufacturer instructions;
  • unauthorised modification or repair;
  • incompatibility that was not disclosed to us before purchase;
  • use of a product outside its stated specification;
  • aircraft defects, wiring faults or external systems;
  • regulatory refusal or failure to obtain an approval; or
  • events outside our reasonable control.

For business customers, we will not be liable for loss of profit, revenue, business, contracts, opportunity, anticipated savings, goodwill or any indirect or consequential loss.

For business customers, our total liability relating to an order will normally be limited to the amount paid for the product giving rise to the claim, except where such a limitation would be unlawful or unreasonable.

These limitations do not reduce any rights that a consumer cannot legally waive.

19. Events outside our control

We are not responsible for delay or failure caused by events outside our reasonable control, including manufacturer delays, supply shortages, industrial action, transport disruption, customs delays, natural events, severe weather, war, civil disturbance, government action or failure of communications or payment systems.

We will take reasonable steps to minimise the effect of the event and will contact you where your order is materially affected.

20. Business customers

Where you purchase wholly or mainly for business purposes:

  • you confirm that you have the authority to place the order;
  • cancellation rights intended specifically for consumers do not apply;
  • returns of non-faulty products are accepted only with our prior written agreement;
  • any quotation is valid for the period stated in it;
  • you are responsible for checking specifications and suitability before ordering; and
  • the business-liability provisions in these terms apply.

Any additional or conflicting terms contained in your purchase order or other document will not apply unless we expressly agree to them in writing.

21. Ownership of products

Products remain our property until we have received full payment.

Risk of loss or damage passes in accordance with applicable law. For consumer deliveries arranged by us, risk will normally pass when the products are delivered to you or to a person identified by you to receive them.

For business customers, risk may pass when the products are delivered to the carrier, as stated in the quotation or agreed-upon shipping terms.

22. Website content and intellectual property

The content of our website, including text, layout, graphics and branding, belongs to us or is used with permission.

You may use the website for personal or legitimate business purchasing purposes. You may not copy, reproduce, republish or commercially exploit its content without permission.

Manufacturer names, trademarks, product images and technical materials remain the property of their respective owners.

23. Personal information

We process personal information in accordance with our Privacy Policy.

Payment providers, delivery companies, manufacturers and service organisations may also process your information under their own privacy policies.

24. Complaints

Please contact us if you are dissatisfied with a product or service. We will aim to investigate and respond within a reasonable time.

Nothing in this section prevents a consumer from seeking independent advice or using any legal remedy available to them.

25. Changes to these terms

We may update these terms from time to time. The version that applies to your order will normally be the one published or provided when the order was placed.

26. If part of these terms is invalid

If any part of these terms is found to be unlawful or unenforceable, the remaining terms will continue to apply.

27. No waiver

If we delay enforcing a right under these terms, that does not mean that we have waived that right.

28. Third-party rights

Unless expressly stated otherwise, no person other than you and AeroDesign.uk has the right to enforce these terms.

29. Governing law

These terms are governed by the laws of England and Wales.

If you are a consumer living elsewhere in the United Kingdom, you may also benefit from the mandatory laws and courts applicable in the part of the United Kingdom where you live.

Business customers agree that the courts of England and Wales will have exclusive jurisdiction over disputes arising from these terms.
